Contracts / Templates

A range of standard form contracts and templates are available below for University personnel to download and use.

Each contract has been drafted for a specific type of arrangement and will contain the particular terms and conditions��relevant to that type of arrangement. The fact that it is "standard" does not mean it is��a generic contract that is suitable for other types of arrangements.

Please refer to the relevant guidelines when using the contracts and templates, and contact the Legal and Risk helpdesk if you require amendments or other support.

Standard form contracts and templates

Competition Template Terms and Conditions	Before using this template, you must check the Competitions, Lotteries and Promotions Flowchart to ensure this is the appropriate template.�� This template is not appropriate if the winner is selected by random draw.�� Refer to the Competition Template Terms and Conditions Guidelines for details about how to use this template.
Confidentiality agreement (NDA) - mutual (two way) Also known as a non-disclosure agreement (NDA)	For use when sharing confidential information with an external party before entering into a formal relationship, for example when developing a joint submission for a grant application. Also known as a non-disclosure agreement (NDA).��Refer to the Confidentiality agreement mutual (two-way) guidelines when using this template. If the agreement relates to a research project, venture or collaboration, please contact Business Development��for the relevant template.
Confidentiality agreement (NDA) - (one way) Also known as a non-disclosure agreement (NDA)	For use when the University will be disclosing confidential information to an external party before entering into a formal relationship, for example during preliminary discussions and negotiations or when developing a joint submission for a grant application. Also known as a non-disclosure agreement (NDA).��Refer to the Confidentiality agreement (one way) guidelines when using this template. If the agreement relates to a research project, venture or collaboration, please contact Business Development��for the relevant template.
Consultancy services agreement	For use when engaging a consultant to undertake straightforward and low-risk consultancy services for a fee of up to $50,000. Refer to the Consultancy services agreement guidelines when using this template. For guidance on whether a person should be engaged as a consultant / contractor vs employee, refer to the Contractor Management webpage.
Credit transfer agreement	For use when entering into a formal agreement with a partner institution for a student mobility arrangement which involves granting credit (in a pre-determined and consistent manner) in recognition of studies successfully completed at the partner institution upon admission to certain University programs. Refer to the Credit transfer agreement guidelines when using this template.
Deeds - guidance on signing deeds��(University login required)	If you manage contracts at the University, you may come across deeds such as deeds of confidentiality, deeds of assignment, deeds of novation, deeds of variation, and deeds of gift.��There are formal requirements for signing deeds.��As a body corporate, the University is required to sign deeds either under seal or by power of attorney.��For more information about deeds, please visit the��Deeds webpage��(University login required).
Deed of Gift	To be used to document financial gifts made by donors to the University, including where the gift is made to set up an endowment fund with the University.
Electronic signatures guideline	Guidelines on approved use of electronic signatures within the University.
Executing Written Agreements��- Guidance Notes	Guidance regarding the different common types of agreements and how those agreements may be signed for and on behalf of the University.
Funding Agreement (Clinical Academic) - Full Funding	For use when entering into an agreement with an organisation (normally a Local Health Network or a private health services provider) for concurrent employment of a registered health practitioner in both an academic position (by the University) and as a clinician (by the other organisation).�� Refer to the Funding Agreement (Clinical Academic) Guidelines when using these templates.

Internship / work experience hosting agreement (Australian)	For use when hosting a student on internship / work experience. Student is enrolled in an Australian institution. Internship / work experience hosting agreement (overseas)	For use when hosting a student on internship / work experience. Student is enrolled in an overseas institution. Minor Trade Promotion Terms and Conditions Template	Before using this template, check the University’s Competitions, Lotteries and Promotions Flowchart to ensure this is the correct template. This template is appropriate only for ‘Minor Trade Promotions’ as defined in the Lotteries Act (free entry, winners by random draw, total prize value less than $5000 in value). Refer to the Minor Trade Promotion Terms and Conditions Guidelines before using this template.
Photo / recordings release form	For use to obtain a person’s consent for a photo or recording of them to be used by the University.��Refer to the photo / recordings release form guidelines when using this template. If the subject is under 16, use the photo / recordings release form template for minors.
Release and indemnity - student mobility template	For use when the University is recommending the other party's services to our students, and the University doesn't have a contract in place with that party. Refer to the Release and indemnity - student mobility guidelines when using this template.
Student works release template	For use to obtain a student’s consent for the University to use the student’s material. Refer to the Student works release guidelines when using this template.
Study Tour (English Language Centre)	For use by English Language Centre when arranging study tours.
Visitor agreement template	For use where an academic or student from another institution is visiting the University and may take part in activities with University staff, intellectual property or facilities. Refer to the Visitor agreement guidelines when using this template.

Common Issues - Software End User Terms	This note highlights common issues in software contracts. It is only to be used as guidance for University personnel purchasing a licence or subscription for software that has already passed an ITDS software assessment��(staff access only)
Compliance breach report template	This form should be used to report a breach of a legal or regulatory requirement.
Contract approval and sealing request form	This form should be used to provide details and context about a contract to the authorised delegate to assist them in understanding what he or she is being asked to approve and refer for sealing.

Contract register access request form	Complete this form to request user access to the University Contract Register. The Contract Register User Manual provides guidance on how to use the register including adding contracts and generating reports.

Global mobility risk assessment form	This risk assessment form must be completed for new overseas mobility activities and activities involving travel to a country that is designated by the Department of Foreign Affairs and Trade as Level 3 - ‘reconsider your need to travel’ or Level 4 - ‘do not travel’, or where sanctions may apply.
